definition of key terms

The following key terms shall apply to these Terms of Service:

Service: The Free UX Booster service offered by Uxemplary.
UX Boost or Boost: A user experience and user interface audit conducted by Uxemplary.
Free UX Boost: The free version of the UX Boost service offered by Uxemplary.
Queue: The order in which requests for UX Boosts are received and processed, based on a first-come-first-served basis.
Skip Queue: A premium, paid service that allows users to prioritize their UX Boost over those already in the queue.
Request: Any submission made through the website for a UX Boost, whether free or paid.
Results: The output produced by Uxemplary following completion of a Request.
User(s): The individual(s), entity(ies), or organization(s) making a Request.

user obligations

By submitting a Request, Users agree to provide all necessary information for Uxemplary to complete the Request, including, but not limited to, a clear description of issues encountered, relevant links, and any additional context deemed essential for successful execution of the UX Boost. Failure to comply with these obligations may lead to delays in processing the Request or denial of Services.

intellectual property rights

For Free UX Boosts, Uxemplary transfers all associated intellectual property rights to the User. Upon receipt of confirmed payment in full for Paid UX Boosts, Uxemplary agrees to transfer all associated intellectual property rights to the User. However, Uxemplary reserves the right to display and utilize Results for marketing and promotional purposes.

By accepting these Terms of Service, Users consent to receiving periodic communications from Uxemplary, including newsletters, updates, and other informational materials.

By accepting these Terms of Service, Users consent to the materials produced while rendering the Service to be published throughout various public channels, and social media networks.

Uxemplary offers a 100% refund for Skip Queue purchases when requested within 1 business day of delivery of Results. No monetary reimbursements will be granted beyond this period, or for any other Services provided.

denial of service

Uxemplary maintains the right to refuse access to the Service at any time, without notice or explanation.

warranty disclaimer

All Services are offered "AS IS." Uxemplary disclaims all warranties, expressed or implied, concerning the provision of Services, including, but not limited to, accuracy, timeliness, performance, compatibility, and fitness for a particular purpose. Additionally, Uxemplary does not recognize nor adhere to deadlines imposed by Users.

In no event shall Uxemplary be held responsible for any damages arising directly or indirectly from the utilization of Services, regardless of foreseeability or negligence. Nevertheless, Uxemplary remains committed to delivering quality Services with utmost diligence and integrity.

domain restrictions

Each domain is eligible for one Free UX Boost. Multiple Paid UX Boosts can be purchased for the same domain as desired.

indemnification

Users hereby pledge to defend, indemnify, and hold Uxemplary, along with its subsidiaries, affiliates, directors, officers, agents, co-branders, partners, contractors, and employees, harmless against any claim or demand, including reasonable attorneys' fees, brought forth due to violation of these Terms of Service or infringement of third party rights.

governing law & jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of Serbia. Any dispute arising out of or pertaining to these Terms of Service shall be subject to the exclusive jurisdiction of the courts in Serbia.
